MarathonOS Terms of Service
The rules and responsibilities that apply when you use the MarathonOS race-preparation app.
Terms overview
These Terms of Service ("Terms") govern your access to and use of MarathonOS, the iOS race-preparation app provided by 42Cal ("we," "us," or "our"). By creating an account, accessing marathonos.app, or installing the MarathonOS mobile application, you agree to comply with these Terms in addition to any applicable platform policies (including Apple App Store rules and the Strava and Garmin Connect API terms). If you do not agree, do not use MarathonOS.
MarathonOS helps runners prepare for a specific race: a countdown and daily brief, travel and start-line logistics, checklists, pace bands and fueling timelines, readiness analytics built from runs imported from Apple Health, Strava, or Garmin, and post-race results and reflections. Features described in these Terms are the features available in the current release. We may add or retire features over time as described under Service Availability & Modifications.
- You must be at least 13 years old (or the minimum age in your jurisdiction) to create a MarathonOS account.
- You agree to provide accurate, current, and complete registration information and to maintain it as such.
- Accounts are personal. You may not share login credentials with others or create an account for someone else without permission.
- We may suspend or terminate accounts that violate these Terms or applicable laws.
You agree to use MarathonOS responsibly and in accordance with all applicable laws, policies, and API partner requirements. You will not:
- Upload or transmit content that is unlawful, defamatory, obscene, harassing, or infringing.
- Access, probe, or disrupt any system or network without authorization.
- Reverse engineer, decompile, scrape, or otherwise exploit the platform beyond its intended features.
- Use automated scripts or bots to collect data except through documented APIs with our permission.
- Misrepresent training data, fabricate races, or violate Strava, Garmin Connect, or Apple policies through your use of MarathonOS.
- Attempt to gain unauthorized access to other users’ data or share OAuth tokens with third parties.
We reserve the right to investigate violations and cooperate with law enforcement or impacted partners.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you suspect unauthorized access, notify us immediately at support@42cal.com. We implement industry-standard safeguards—including HTTPS, encrypted OAuth tokens, and iOS Keychain storage—but we cannot guarantee absolute security.
MarathonOS connects with Apple Health, Strava, and Garmin Connect to import your runs. When you authorize an integration:
- You grant us permission to access and process data from the selected provider solely to deliver MarathonOS features.
- You remain subject to the third party’s terms and policies; you are responsible for complying with them.
- You can revoke access at any time from within MarathonOS or the respective provider. Revocation may disable related features.
- We do not control third-party services and are not liable for their performance or data handling practices.
You retain ownership of the workouts, race results, notes, and other content you submit to MarathonOS. To operate the service, you grant 42Cal a worldwide, non-exclusive, royalty-free license to host, use, reproduce, and display that content solely for providing and improving MarathonOS and fulfilling legal obligations.
You represent that you have the right to submit the content and that doing so does not infringe any third party’s rights. You may delete content at any time; residual copies may persist in backups for a limited period consistent with our Privacy Policy.
MarathonOS, including its software, design system, trademarks, logos, and documentation, is owned by 42Cal or its licensors and is protected by intellectual property laws. Except for the limited rights granted under these Terms, we retain all rights, title, and interest in the platform. You may not remove proprietary notices, copy interfaces, or build competing services using our confidential information.
MarathonOS is provided on an "as is" and "as available" basis. We aim for high reliability but do not guarantee uninterrupted access, error-free operation, or data preservation. Planned maintenance, emergency outages, or failures of partner APIs may limit functionality.
We may modify, suspend, or discontinue features with or without notice (for example, when API partners change their programs). If we make material changes that negatively impact you, we will provide reasonable advance notice when practicable.
You may request a copy of your data in JSON or CSV format by emailing support@42cal.com with subject "Data Export Request". We will provide your data within 30 days. This includes:
- All imported and manually logged runs
- Races, checklists, logistics, pace and fueling plans, race results, and reflections
- Integration connection history
- Account information
Exported data is yours to use as you wish, including importing to other platforms.
MarathonOS integrates with third-party services (Apple HealthKit, Strava, and Garmin). We are not responsible for:
- Third-party service outages or data loss
- Changes to third-party APIs that affect functionality
- Third-party service policy changes
- Loss of data if a third-party revokes our API access
We will make reasonable efforts to notify you of integration issues, but cannot guarantee uninterrupted access to third-party data.
If you downloaded MarathonOS from the Apple App Store, you also agree to:
- Apple's Licensed Application End User License Agreement ("EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
- Apple's terms regarding In-App Purchases and subscriptions
- Apple's refund policies for subscriptions
In case of conflict between these Terms and Apple's EULA, Apple's EULA controls for App Store-related matters.
"MarathonOS", "42cal", and associated logos are trademarks of 42cal. You may not:
- Use our trademarks without permission
- Create similar or confusing branding
- Imply endorsement by MarathonOS
You may reference MarathonOS in blog posts, social media, or reviews for informational purposes only.
Free Tier:
Creating races and connecting Apple Health, Strava, or Garmin are free. For the first race you add, unlimited checklists and that race's race report are included at no cost. We may change free tier features at any time with notice.
Premium:
Premium adds race logistics, fueling plans, pace bands, goal analysis, unlimited checklists and race reports across every race, and advanced readiness analytics. It is sold only through Apple App Store In-App Purchase in the following options:
- Premium Monthly — $5.99 per month, auto-renewing, with a 7-day free trial for eligible new subscribers.
- Premium Annual — $39.99 per year, auto-renewing, with a 7-day free trial for eligible new subscribers.
- Race Block Pass — $24.99 for 20 weeks of premium access. This is a non-renewing subscription: it does not auto-renew and no trial applies. You may purchase it again after it expires.
Prices are in U.S. dollars and may differ by App Store storefront and local taxes. The price shown in the app at the time of purchase is the price that applies.
Billing, Renewal, and Cancellation:
- Payment is charged to your Apple ID account at confirmation of purchase.
- Monthly and annual subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- Manage or cancel your subscription in the app under Profile > Settings > Subscription > Manage Subscription, or in iOS Settings > [your name] > Subscriptions. Deleting the app does not cancel a subscription.
- If you cancel, premium access continues until the end of the period you already paid for.
- Any unused portion of a free trial is forfeited when you purchase a subscription.
- Purchases are processed by Apple. Refunds are handled by Apple under its App Store policies; we cannot issue refunds directly.
- We may change prices. Existing subscribers receive at least 30 days notice, and Apple will ask you to consent to a price increase before it takes effect.
Use of the App Store is also subject to Apple's Licensed Application End User License Agreement, linked under Apple App Store Terms above.
You may stop using MarathonOS at any time by deleting your account or uninstalling the app. We may suspend or terminate your access if you violate these Terms, misuse integrations, engage in fraudulent or harmful behavior, or create undue risk to other users or our partners.
Upon termination, your right to use MarathonOS ceases immediately and we will delete your personal data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination will continue to apply (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution).
⚠️ IMPORTANT HEALTH NOTICE
Marathon training is physically demanding and carries inherent risks including but not limited to:
- Cardiovascular events
- Musculoskeletal injuries
- Heat-related illness
- Dehydration
- In rare cases, serious injury or death
You MUST consult a licensed physician before starting any training program, especially if you have or suspect:
- Heart disease or cardiovascular conditions
- High blood pressure
- Diabetes or pre-diabetes
- Asthma or respiratory conditions
- Joint, bone, or musculoskeletal problems
- Pregnancy or recent childbirth (within 6 months)
- Any condition requiring medical supervision
MarathonOS strongly recommends:
- Annual physical examination with cardiovascular screening
- Adequate health and accident insurance coverage
- Having an emergency action plan when training
- Training with a partner when possible
- Immediate cessation of training if you experience chest pain, severe shortness of breath, dizziness, unusual fatigue, or loss of consciousness
Seek immediate medical attention if you experience warning signs during or after training.
MarathonOS provides training insights and analytics for informational purposes only. We do not offer medical advice, diagnosis, or treatment. You assume responsibility for your training decisions and for ensuring workouts are safe for your circumstances.
To the fullest extent permitted by law, 42Cal and its officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, resulting from your use of MarathonOS or inability to access it.
Our total liability for any claim arising from or relating to these Terms or MarathonOS will not exceed the greater of (a) the amounts you paid to us in the 12 months preceding the event giving rise to the claim or (b) $100 USD. Some jurisdictions do not allow certain limitations; in those cases, the above limitations apply only to the extent permitted by law.
You agree to indemnify and hold harmless 42Cal, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of MarathonOS, your violation of these Terms, or your infringement of any third-party rights.
United States Users
This Agreement shall be governed by the laws of the State of California, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Mexico Users
For users in Mexico, this agreement is subject to both California law and applicable Mexican consumer protection laws (Ley Federal de Protección al Consumidor). In case of conflict between California law and Mexican consumer protection law, the provisions more protective of consumer rights shall apply.
Mexican users may also seek resolution through PROFECO (Procuraduría Federal del Consumidor) for consumer-related disputes.
Before filing a formal claim, you agree to contact us at support@42cal.com to attempt to resolve the dispute informally within 30 days. If we cannot resolve the dispute, the parties agree to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will take place in San Francisco County, California, in English, before a single arbitrator.
Either party may seek injunctive relief in court to prevent unauthorized use or misuse of confidential information or intellectual property. You may also pursue claims in small claims court where jurisdictional requirements are satisfied.
YOU AND 42CAL WAIVE THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. Claims must be brought in a party’s individual capacity.
We may update these Terms from time to time. When we do, we will post the revised Terms on this page, update the "Last updated" date, and, if changes are material, provide additional notice (such as email or in-app messaging). Your continued use of MarathonOS after the revised Terms become effective constitutes acceptance.
