42cal Race Directory Terms of Service

These Terms of Service ("Terms") govern your access to and use of the 42cal race directory at 42cal.com, a web platform that helps runners discover and bookmark marathon races worldwide ("we," "us," or "our"). By creating an account or using the 42cal race directory, you agree to comply with these Terms. If you do not agree, do not use the race directory.

• You must be at least 13 years old (or the minimum age in your jurisdiction) to create a 42cal account.
• You agree to provide accurate, current, and complete registration information and to maintain it as such.
• Accounts are personal. You may not share login credentials with others or create an account for someone else without permission.
• We may suspend or terminate accounts that violate these Terms or applicable laws.

You agree to use the 42cal race directory responsibly and in accordance with all applicable laws. You will not:

• Upload or transmit content that is unlawful, defamatory, obscene, harassing, or infringing.
• Access, probe, or disrupt any system or network without authorization.
• Use automated scripts, bots, or scrapers to collect race data without our written permission.
• Attempt to gain unauthorized access to other users' accounts or bookmarked races.
• Misuse the race directory to spam, phish, or distribute malware.

We reserve the right to investigate violations and cooperate with law enforcement.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you suspect unauthorized access, notify us immediately at support@42cal.com. We implement industry-standard safeguards including HTTPS and encrypted authentication via Clerk, but we cannot guarantee absolute security.

The 42cal race directory aggregates publicly available race information from various sources. You can bookmark races and view them on your personal dashboard.

• Race Information Accuracy: We strive to provide accurate race data, but we do not guarantee the accuracy, completeness, or timeliness of race information. Always verify race details directly with race organizers before registering.
• Bookmarked Races: Your bookmarked races are private by default and visible only to you. We do not share your bookmarks with third parties.
• No Registration Services: 42cal does not handle race registrations or payments. We provide links to race organizers' registration pages for your convenience.

You retain ownership of any content you submit to the 42cal race directory (such as race reviews, if applicable). To operate the service, you grant 42cal a worldwide, non-exclusive, royalty-free license to host, use, reproduce, and display that content solely for providing and improving the race directory.

You represent that you have the right to submit the content and that doing so does not infringe any third party's rights.

The 42cal race directory, including its software, design, trademarks, logos, and race data compilation, is owned by 42cal or its licensors and is protected by intellectual property laws. Except for the limited rights granted under these Terms, we retain all rights, title, and interest in the platform.

You may not scrape, copy, or redistribute race data without our written permission.

The 42cal race directory is provided on an "as is" and "as available" basis. We aim for high reliability but do not guarantee uninterrupted access, error-free operation, or data preservation. Planned maintenance or unexpected outages may limit functionality.

We may modify, suspend, or discontinue features with or without notice (for example, when updating our race data sources). If we make material changes that negatively impact you, we will provide reasonable advance notice when practicable.

The 42cal race directory is currently free to use. We may introduce paid features or premium memberships in the future. If we do:

• We will provide clear pricing and feature descriptions
• Existing free features may remain free or become paid
• We will provide 30 days notice before charging for previously free features
• Fees will be handled via Stripe or other payment processors

You may stop using the 42cal race directory at any time by deleting your account. We may suspend or terminate your access if you violate these Terms, engage in fraudulent behavior, or create undue risk to other users.

Upon termination, your right to use the race directory ceases immediately and we will delete your personal data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination will continue to apply (including intellectual property, disclaimers, limitation of liability, and dispute resolution).

The 42cal race directory provides race information for informational purposes only. We do not endorse, verify, or guarantee the accuracy of race data. We are not responsible for:

• Race cancellations, postponements, or changes
• Registration issues with race organizers
• Race course conditions, safety, or organization
• Third-party registration or payment processing

Always verify race details directly with race organizers before registering or traveling to an event.

To the fullest extent permitted by law, 42cal and its officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, resulting from your use of the race directory or inability to access it.

Our total liability for any claim arising from or relating to these Terms or the race directory will not exceed $100 USD. Some jurisdictions do not allow certain limitations; in those cases, the above limitations apply only to the extent permitted by law.

You agree to indemnify and hold harmless 42cal, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the race directory, your violation of these Terms, or your infringement of any third-party rights.

These Terms are governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law principles.

Before filing a formal claim, you agree to contact us at support@42cal.com to attempt to resolve the dispute informally within 30 days. If we cannot resolve the dispute, the parties agree to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will take place in San Francisco County, California.

You may also pursue claims in small claims court where jurisdictional requirements are satisfied.

YOU AND 42CAL WAIVE THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. Claims must be brought in a party's individual capacity.

We may update these Terms from time to time. When we do, we will post the revised Terms on this page, update the "Last updated" date, and, if changes are material, provide additional notice (such as email). Your continued use of the race directory after the revised Terms become effective constitutes acceptance.
